Online store terms and conditions constituting terms for electronic services
1. General provisions
1.1. These terms and conditions (hereinafter referred to as: “Terms and Conditions”) define the rules for concluding and performing contracts for electronic services and sales contracts in the online store fltgrupa.pl as well as the rights and obligations of the parties to these contracts.
1.2. The online store fltgrupa.pl(hereinafter referred to as: “Store”), referred to in point 1.1., is available exclusively for entrepreneurs (hereinafter “Users”) at the address: https://fltgrupa.pl/sklep/ The owner of the store (hereinafter referred to as: “Seller”) is FLT Grupa sp. z o.o. ., with its registered office at ul. Wrocławska 1W, 51-361 Wilczyce NIP 8961422893, REGON 020432296

1.4. Contracts for electronic services and sales are concluded with the Seller through the Store.
1.5. The subject of the Seller’s activity is the sale of forklifts, warehouse and pallet trucks as well as spare parts and accessories (hereinafter referred to as: “Products”).
The Store enables:
- Obtaining information about Products that can be purchased through the Store,
- Placing orders (hereinafter: “Orders”) by Users (then called: “Buyers”),
- Browsing the site in mobile version for Users using mobile devices.
1.6. In the Terms and Conditions, the term “Entrepreneur” means a natural person, legal person or organizational unit that is not a person, having legal capacity, conducting business activity. Entrepreneurs are also partners of a civil partnership in the scope of their business activity (art. 4 of the Act of April 30, 2018, Entrepreneurs’ Law).
1.7. In order to place an order, it is necessary to accept the Terms and Conditions by checking the appropriate checkbox located in the order form.
1.8. Simply using the Store does not require the User to pay any fees.
2. Orders
2.1. Orders in the Store can be placed by entrepreneurs.
2.2. Orders in the Store can be placed using a form, without the need to register in the Store.
2.3. To place an order, it is necessary to accept the Terms and Conditions.
Orders must contain the following data:
- Name of the User placing the order
- Delivery address
- E-mail address
- Phone number
- Name and quantity of ordered Products
- VAT number
- Selected delivery method
- Selected payment method
2.4. The order placement procedure is always completed by the User effectively clicking the button: “place order”, which is equivalent to the User confirming that the Order form has been filled out correctly, and that the user is aware that the fulfillment of the Order entails the obligation to pay, including bearing the selected delivery costs.
2.5. In case of incorrect completion of the Order form, the Buyer may make changes by phone or e-mail or completely cancel the Order, provided that it has not yet been sent.
2.6. After placing an Order, a message containing confirmation of the Order placement by the User is immediately sent to the e-mail address indicated in the form.
2.7. The contract is concluded when the Seller informs about starting the Order fulfillment. Such confirmation will be sent by e-mail.
2.8. The Seller may suspend the acceptance of an Order in case of doubts about the truthfulness or reliability of the data indicated by the Buyer in the registration form. In such case, the Seller will immediately contact the Buyer to clarify these doubts.
2.9. In case of unavailability of products included in the order, the Seller will inform the Buyer about the impossibility of order fulfillment and agree with them on the method of refunding the paid amount. If the impossibility of Order fulfillment concerns only temporary unavailability of products, the Seller will inform the Buyer about the potential deadline for fulfilling the placed Order by phone or in an e-mail message to the address indicated by the Buyer in the Order form.
2.10. At the Buyer’s request, specified by checking the appropriate checkbox when filling out the registration form, the Seller, after booking the payment to their account, will provide the Buyer with a VAT invoice – in the package or by e-mail.
2.11. The Buyer may optionally enter comments to their Order.
2.12. Orders are fulfilled according to the order in which they are placed.
3. Prices and payments
3.1. Product prices are given in Polish zloty (PLN) and are gross prices. There is also an option to change the currency to US dollar (USD) or euro (EUR). The Product prices given in the store do not include delivery costs. The total cost of the Order including delivery costs will be provided to the Buyer before final order placement, by clicking the button: “place order”.
The following online payment methods are available for the Buyer to choose from:
- Przelewy24
- Installments for Companies
- Leasing
- Prepayment based on proforma invoice
- Term transfer for permanent and registered corporate Clients
3.2. Credit card and e-transfer transaction settlements are carried out through the przelewy24.pl website
3.3. Payment for ordered Products should be made by the User within 3 business days from the conclusion of the contract.
3.4. The Seller provides a VAT invoice along with the Product.
3.5. The Seller reserves the right to change prices and delivery costs, especially in case of changes in price lists of services provided by the entity carrying out deliveries. This point does not apply to Orders being fulfilled.
4. Delivery
4.1. Delivery takes place within Poland, as well as to European Union countries. Shipping to countries outside the European Union is possible, after prior agreement with the Seller on delivery costs.
4.2. Order fulfillment begins from the moment of its confirmation. The expected delivery or pickup date is specified on the order confirmation. The availability given on the product card is indicative and specifies the number of business days needed to fulfill the order. The actual order fulfillment time may vary depending on the ordered quantity of products, payment method and delivery method.
4.3. Delivery is carried out from Monday to Friday, except for statutory holidays.
4.4. Products ordered by the Buyer are delivered through courier companies DHL, InPost or to parcel lockers and by road transport.
4.5. In case of some international shipments, the carrier may be a different courier company than the one mentioned in point 4.4., and the Order fulfillment time may be extended.
Delivery costs within Poland are determined depending on the net order value according to the table below:

The Seller reserves the right to change delivery costs in the following cases:
- Delivery to different pickup points.
- Multiple deliveries at different times.
- Special promotions.
4.6. Large package dimensions will be priced individually.
4.7. It is also possible to collect the order free of charge by the Client at the headquarters of FLT GRUPA company in Wilczyce near Wrocław ul. Wrocławska 1W, 51-361 Wilczyce
5. Order fulfillment time
Delivery forms in the store:
Courier shipment – in most cases delivery time is up to 48h (on business days), in extraordinary situations it may be extended (e.g. holiday periods, carrier vehicle breakdown, etc.). The delivery status can be tracked directly on the carrier’s website after receiving the shipment number from us.
Road transport – 2 to 5 business days from the moment of ordering (e.g. after payment). In case of purchasing used equipment, transport is agreed with the Buyer individually
Self-pickup at the company headquarters – after prior agreement with the Seller.
5.1. The form of delivery depends on the quantity and dimensions of purchased products. Products with availability status “Goods in stock”, qualifying for courier shipment
5.2. Information about product availability (fulfillment time) does not constitute an offer or element of an offer within the meaning of the Civil Code.
6. Returns
6.1. The Buyer may only and exclusively with the consent and on conditions determined by the Seller return/exchange the delivered goods.
6.2. In case of return/exchange of goods or resignation from the order, the Seller reserves the right to deduct up to 20% of the gross value of the order subject.
6.3. The costs of delivery of returned/exchanged goods are borne by the Buyer.
6.4. If the sent product was not collected by the Buyer, the Seller reserves the right to charge the Buyer with transport costs.
7. Complaints
7.1. The Seller does not provide warranty on their products unless the warranty is included in the product description.
The purchased product is subject to complaints for two years from the date of its receipt, if the following is found:
- defect
- incompleteness,
- non-compliance with description.
7.2. The product may also be subject to complaint if it does not meet the Buyer’s expectations due to a defect arising during production. The manufacturer, in such situation, may repair the damage free of charge, replace the Product, or refund money – at their discretion.
7.3. The warranty does not cover Products that have been damaged during improper maintenance, neglect, normal wear, as well as natural processes as a result of prolonged use.
The complaint does not require a special form, but should contain:
- Data allowing identification of the User
- Designation of the Product to which the complaint relates
- Justification indicating the Product defect
7.4. The product along with the complaint should be sent to the Seller’s address
7.5. Within 14 days of filing the complaint, the Seller will respond to it and notify about the method of further proceedings.
7.6. The Seller will make efforts to ensure that complaints are considered without undue delay.
7.7. During the complaint process, the Seller may request additional explanations, documents or verification of the course of the event subject to complaint.
7.8. After resolving the complaint, the Seller will inform the complainant about its acceptance or refusal to accept it (whereby information about refusal to accept the complaint will contain justification).
8. Personal data processing
8.1. In order to conclude and perform sales contracts, as well as fulfill the seller’s obligations resulting from the fact of concluding distance sales contracts, the Seller processes the Buyer’s personal data, which the Buyer provides voluntarily. All information regarding personal data processing can be found in the Privacy Policy section.
9. Final provisions
9.1. The Seller reserves the right to change the Store Terms and Conditions.
9.2. Orders placed during the validity of the previous version of the Terms and Conditions will be fulfilled in accordance with its provisions.
9.3. Any disputes arising between the Seller and the Buyer will be resolved by the common court competent due to the Store’s registered office.
9.4. Customers can access these Terms and Conditions at any time via the link posted on the main page of the online Store
9.5. These terms and conditions are effective from January 1, 2023.
