FLT forklift rental regulations:
Lessor – FLT GRUPA Sp. z o.o. company provides short-distance transport equipment (forklift rental) for use in its own name.
Lessee – both natural and legal person, who takes the lease subject for use in their own name.
Lease subject (equipment) – forklift model specified in the regulations.
2. The forklift lessee guarantees that:
• The data provided by them is true, they have full legal capacity, no proceedings are pending against them that could lead to exposing FLT GRUPA Sp. z o.o. to losses, they are aware that equipment operation requires appropriate UDT permits according to applicable regulations, and FLT GRUPA Sp. z o.o. is not responsible for non-compliance with the above requirement by the Lessee.
• The Lessee is obliged to confirm to the Lessor the forklift return date or inform the Lessor about the planned extension of the lease period, no later than one day before the expiration of the term established in the lease agreement.
• The Lessee designates a person responsible for matters concerning contract implementation and for receiving and signing the handover protocol for the above equipment
• The Lessee cannot sublease or lend the equipment that is the subject of the lease to third parties.
• The risk of loss or destruction of the lease subject passes to the Lessee from the moment of lease subject delivery and signing the handover protocol and lasts until the lease subject return to the Lessor and signing the handover protocol.
3. The Lessor guarantees that:
• will not charge lease rent for the lease subject downtime period from the moment of breakdown report until its removal, provided the breakdown did not occur due to the Lessee’s fault.
• undertakes to react to determine further action aimed at damage removal within 12 hours from receiving the report.
4. Equipment use within FLT forklift rental:
• The Lessee will ensure exclusively authorized operation and is responsible for proper use according to its purpose, operating instructions, and safety rules, including performing daily equipment inspections recommended in the operating instructions, e.g., for controlling operating fluid levels.
• The above-mentioned equipment will be returned to FLT GRUPA Sp. z o.o. in non-deteriorated condition.
• The forklift lessee throughout the lease period undertakes to:
– store the lease subject in conditions preventing its destruction by third parties or theft (e.g., in a safe and closed room).
– protect the lease subject from excessive contamination (e.g., paint).
• The Lessee undertakes to cover repair costs due to damage, excessive wear, or contamination of the lease subject resulting from its improper operation or other damage resulting from negligence or lack of supervision. These costs will be calculated based on the handover protocol constituting an integral part of the contract, according to the Lessor’s applicable price list.
• In case of any symptoms of improper lease subject operation or need for its repair, the Lessee is obliged to immediately stop its use and notify the Lessor.
5. Rental duration:
• The parties establish the rental duration based on the forklift Lessee’s written order, which will be accepted and initialed by FLT GRUPA Sp. z o.o. The order is the basis for its implementation and mutual financial settlements.
All changes regarding the period and rental prices require written consent from FLT GRUPA Sp. z o.o.
6. Prices and settlements:
• The basis for financial settlements are prices accepted by FLT GRUPA Sp. z o.o. in the order acceptance confirmation.
• All discussed prices are net prices, to which VAT tax of 23% is added.
• Comments contained in the rental agreement and handover protocol constitute the basis for mutual settlements between companies and financial claims from FLT GRUPA Sp. z o.o.
• The Lessee accepts the Lessor’s price list, which is presented to them in the quotation process
• Payment for the rental period will be made based on a VAT invoice. The VAT invoice will be issued on the first day of rental. The payment term is set individually, however, in case of first cooperation, payment must be made before transferring the equipment to the lessee.
